The petitioner seeks bail in connection with Kachhawa P.S. Case No. 19 of 2017 registered for the offence punishable under Sections-341, 323, 324, 302, 34 of the Indian Penal Code. According to FIR, the petitioner assaulted the deceased with Farsa causing injury on the head of the informant which was cause of death.
Submission of learned counsel for the petitioner is that the doctor has found injury by hard and blunt substance. The law is well settled that eye witness cannot be disbelieved for the aforesaid trivial inconsistency between ocular and medical evidence.
Hence, I am not inclined to enlarge the petitioner on bail
Patna High Court Cr.Misc. No.60161 of 2017 (3) dt.07-02-2018 and as such, prayer for bail is refused.
The learned trial court is directed to expedite the trial and conclude the same as early as possible.
