The petitioner seeks regular bail in connection with Baheri P.S. Case No. 314 of 2022, registered for the offences punishable under Section 304 (B)/34 of the Indian Penal Code. As per the prosecution case, the allegation against the petitioner is that due to non-fulfillment of dowry demand, the petitioner alongwith other co-accused persons have committed dowry death to the daughter of the informant. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence, he is father-in-law of the deceased and has no concern with the mess and business of the deceased as well as her husband as they are living separately from them. There is general allegation against
Patna High Court CR. MISC. No.18546 of 2023(2) dt.18-05-2023 2/2 the petitioner. Petitioner has no criminal antecedent and is in jail custody since 03.01.2023. He further submits that similarly situated co-accused person, namely, Umda Devi and Anita Devi who are mother-in-law and sister-in-law of the deceased have already been granted regular bail vide order dated 10.05.2023 in Criminal Misc. No. 16293 of 2023 by a Co-ordinate Bench of this Court.
Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VII, Darbhanga in connection with Baheri P.S.
