2. The petitioner seeks bail in connection with Banshi P.S. case No. 3 of 2024 instituted for the offences under Sections 304B, 201, 120B, 34 of the Indian Penal Code.

3. Prosecution case, in short, is that the in-laws of the deceased have tortured and killed her for the non-fulfillment of demand of dowry. It is alleged that this petitioner assisted the

Patna High Court CR. MISC. No.20440 of 2024(4) dt.01-05-2024 2/3 accused persons in the alleged crime.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not a relative of the in-laws of the deceased and nor he has any concern with the alleged offence rather he is a covillager. He further submitted that petitioner has got no concern with the alleged offence rather the allegation against this petitioner is that his vehicle was used for carrying the dead body of the deceased and he was driving the vehicle. He further submitted that the said vehicle was provided by the petitioner on the request of the father-in-law of the deceased for the purpose to take the deceased to the hospital but on the way the deceased died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.01.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, no specific allegation as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.20440 of 2024(4) dt.01-05-2024 3/3 bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Banshi P.S. case No. 3 of 2024.
