The petitioner apprehends his arrest in Sonepur P.S. Case No.987 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The police got input that some persons are selling liquor in an orchard situated in village Rahimpur. When the police went to verify the information many persons fled away. The police claimed that on inquiry from the persons present there, it transpired that the petitioner and other two persons were selling liquor.

The learned counsel for the petitioner submits that petitioner is a student. Petitioner has got no criminal antecedent and no material is collected to show that the petitioner was selling any liquor.

No.18825 of 2019(2) dt.28-03-2019 2/2 Taking into consideration the facts that the recovery was made from an orchard and petitioner is said to have fled away but the house of the petitioner was not searched, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 6th, Saran at Chapra in connection with Sonepur P.S. Case No.987 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
