The petitioner seeks bail in connection with Darbhanga Town P.S. Case No. 39 of 2022 dated 11.02.2022 registered for the offence punishable under Sections 147, 149, 341, 323, 325, 327, 285, 288, 307, 354, 436 and 302 of the Indian Penal Code.
The allegation against the petitioner is that he was one of the members of the mob who came with the intention to dispossess the victim from the disputed land. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. However, his name transpired in this case on the basis of the confessional statement of co-accused Chootu Kumar Singh. Learned counsel further
Patna High Court CR. MISC. No.18563 of 2023(2) dt.16-05-2023 2/2 submits that a co-ordinate Bench of this Court vide order dated 28.03.2023 in Cr. Misc. No. 1330 of 2023 has granted regular bail to the similarly situated co-accused namely, Mona Kumar @ Eshan. Learned counsel submits that the petitioner is in custody since 14.02.2022.
Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S. Case No. 39 of 2022.
