Mr. Sri Madan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 09-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 15.02.2018, seeks bail in connection with Baruraj P.S.Case No. 180 of 2017 registered under Sections 395 and 412 of the Indian Penal Code. Accusation in brief, is that, a dacoity was committed in the house of the informant by 30-35 unknown persons and they looted away some jewelleries and cash.

Contention of the learned counsel for the petitioner is that there is no any incriminating article was recovered from the possession of the petitioner and only one loaded country made pistol was recovered and one mobile for which a separate case was lodged under the Arms Act and the recovered mobile is not looted rather the same is his personal one and prior to institution of the present case petitioner had no criminal antecedent and

Having considered the aforesaid facts and circumstances, the petitioner, namely, Vicky Kumar is directed to be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Baruraj P.S.Case. No. 180 of 2017.
