The petitioner apprehends his arrest in a case under Section 3 (a) and 4 of R.P. (U. P.) Act.

The informant intercepted a vehicle, pick up van, bearing registration No. WB-57B/ 8421 and from the said vehicle 31 small pieces of rail were recovered.

It is submitted that petitioner is owner of the vehicle and there is no material to show that the petitioner was in any manner involved in the theft of railway property. The driver of the vehicle was plying the vehicle on hire.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named

Patna High Court Cr.Misc. No.30025 of 2015 (2) dt.28-07-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Katihar in Katihar Case No. CII-5/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
