JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioners seek regular bail in connection with Murliganj P.S. Case No.89 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. Prosecution story as per F.I.R. is that the informant after participating in the monthly meeting regarding audit of accounts in the Chairmanship of the District Magistrate, he was returning to his headquarter at Bihariganj and when reached ahead the Petrol Pump of Village Bhelahi, three persons riding on a bike came and snatched several official documents and etc. i.e. mobiles, 10 pass books, advice letter, register, purse containing cash of Rs.12,000/-, Driving License, Laptop of Dell Company, A.T.M. Card and Unicorn Motorcycle bearing

Patna High Court CR. MISC. No.17760 of 2019(4) dt.21-05-2019 2/2 Registration No.BR-065-2839 and they were fled away from the spot but later on they were arrested during the investigation. Submission of the learned counsel for the petitioners is that petitioners were not named in the F.I.R. as such, they have falsely been implicated in this case and they are in custody since 23.02.2018. Further submission is that the petitioners were not put on TIP.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Murliganj P.S. Case No.89 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
