JUSTICE SUDHIR SINGH ORAL ORDER 31-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 4163 of 2013 for the offences instituted under Section 498(A) of the I.P.C. and 4 of the D. P. Act. Heard learned counsel for the petitioner, learned counsel for the complainant and learned counsel for the State. The accusation is of demand of dowry and on nonfulfilment of the same torture was inflicted by the accused. A general submission has been made that both the parties are agreed to stay together.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall be released on provisional bail in the event of his arrest or surrender before the learned court below within a

Patna High Court Cr.Misc. No.29796 of 2015 (2) dt.31-07-2015 2/2 period of six weeks from today in connection with Complaint Case No. 4163 of 2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The court below is directed to seek appearance of both the parties, in person, and ensure that both the parties are agreed to stay together. If either of the parties disagree to stay together, in the said circumstances the petitioner shall deposit an amount of Rs. 1500/- per month in the court below which shall be released in favour of the informant-complainant and thereafter the provisional bail of the petitioner shall be confirmed.
