The petitioner, who is in custody, seeks bail in connection with Shahpur P.S. Case No. 116 of 2018 registered for the offence punishable under Sections413, 420, 467, 468 and 471 of the Indian Penal Code.
Informant is the Police Inspector, who has stated in his written complaint that on 02.05.2018 when he was on patrolling duty he received a confidential information that six persons with stolen motorcycle have assembled near Shiv Mandir to commit some grave crime. Upon such information, police raided the place and found six persons with two motorcycles standing there and upon seeing the police two
Patna High Court Cr.Misc. No.45669 of 2018(2) dt.27-07-2018 2/2 persons fled away and four persons were arrested alongwith two motorcycles. One motorcycle was recovered from accused Dinesh Sonar and other motorcycle from accused Chandra Shekhar Tiwary.
It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from his possession. He has no criminal antecedent and he is in custody since 02.05.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-XIth, Bhojpur, Ara, in connection with Shahpur P.S. Case No. 116 of 2018.
