JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 14-03-2018 Heard learned counsel for the petitioner; State and the Bihar State Construction Corporation Limited (hereinafter referred to as the 'Corporation').
2. At the very outset, learned counsel for the Corporation submitted that the Corporation is undergoing liquidation before the National Company Law Tribunal, Kolkata (hereinafter referred to as the 'Tribunal').
3. Learned counsel has also produced copy of order dated 31.01.2018 passed in C.W.J.C. No. 17815 of 2016, in the case of
Patna High Court CWJC No.16370 of 2016 dt.14-03-2018 2/2 Laxman Ram vs. The State of Bihar & Ors., by which the writ petition has been disposed off with liberty to the petitioner to intervene/file an appropriate petition before the Tribunal.
4. In view of the aforesaid, the present dispute relating to payment of retiral benefits of the petitioner being a liability on the Corporation, has to be adjudicated by the Tribunal in the winding up proceeding.
5. Accordingly, the writ petition stands disposed off with liberty to the petitioner to intervene/file an appropriate petition before the Tribunal in the winding up case of the Corporation in respect of the grievance raised in the writ petition.
