In this case, the petitioner is apprehending his arrest in connection with Madhepura P.S. Case No. 127 of 2016 registered for offences under sections 366(A)/34 of the Indian Penal Code.

In this case, an allegation has been made that on 3.3.2016 at about 5 PM, when the Informants' daughter, namely, Sweety Kumari along with her youngest sister Chunni Kumar had gone to walk in the maize field then the co-accused Amit Kumar and Guriya Devi forcibly took away Sweety Kumari. In the statement made under Section 164 Cr.P.C., the victim girl has taken the name of the present petitioner and

No.17386 of 2019(2) dt.26-03-2019 2/2 one Amit Kumar who have lifted her and taken away to Chandani Chowk, and thereafter, to Murliganj at the house of Amit Kumar where Amit Kumar forcibly married with her. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will take decision in accordance with law on the same day of his appearance.
