Heard learned counsel for the petitioners and the learned AC to SC-10.

Learned counsel for the petitioners submits that the instant writ application has been filed for quashing the Aam Notice dated 2-1-2025 (Annexure-7) issued by the Circle Officer, Mansi with respect to the land pertaining to Mauza- Balha, Thana No. 175, Khata No. 250, Khesra No. 1230, Area- 3 bigha 10 katha, District-Khagaria for construction of play ground and farmer building (Kisaan Bhawan).

The learned State counsel submits that it appears that petitioners have rushed to this Court seeking the aforesaid relief
Patna High Court CWJC No.4992 of 2025(2) dt.10-07-2025 2/2 and thereafter draws the attention of the Court to Notice dated 2-12025 (Annexure-7) to submit that from perusal of the Notice dated 2-1-2025, it would manifest that the same is Aam notice issued by the Circle Officer seeking objection with respect to the land in dispute on which play ground and farmer building are to be constructed. Learned State counsel further submits that the petitioners, instead of rushing to this Court, ought to have objected the aforesaid Notice dated 2-1-2025 by bringing on record all the relevant documents relating to the land in dispute in the instant writ application showing that the land is their raiyati land. 4.
Learned counsel for the petitioners, at this stage, seeks permission to withdraw the writ application with liberty to file objection to the Notice dated 2-1-2025 issued by the Circle Officer, Mansi, as it has been submitted that till date construction of play ground and farmer building has not started. 5.
Permission is accorded.

Accordingly, the instant writ application is dismissed as withdrawn with liberty aforesaid.
