The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 420 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, huge quantity of foreign liquor was recovered from the possession of the coaccused persons and petitioner was working as a carrier of prohibited foreign liquor associated with the co-accused persons. Petitioner claims that he is having clean antecedent

Patna High Court Cr.Misc. No.52319 of 2017(2) dt.09-11-2017 2/2 and is in custody since 12.07.2017.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-IIIcum-Special Judge, Excise, Purnea in connection with Special Excise Case No. 1963 of 2017 arising out of Rupauli (Mohanpur) P.S. case No. 159 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
