JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,447,504,506 and 354B/34 of the Indian Penal Code and sections 3(1)(x)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The accusations are of entering into the house of the informant on 13.1.2015 and abusing by calling the caste name and pressurizing the informant to vacate the house in question. Subsequently, on 14.1.2015 the petitioners dragged the victim, abused and assaulted with fists and slaps.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.29825 of 2015 (2) dt.14-07-2015 2/2 that the informant had captured the house of the petitioners for which several applications were filed before the authorities and proceedings were initiated against the informant. It is further submitted that the learned S.D.M., Munger directed the informant for vacating the house in question on 6.11.2014, thereafter the present case was lodged on 16.1.2015 for the occurrence of 13.1.2015.
Considering the fact that the accusation, levelled in the background of dispute with regard to the title and possession of the house in question, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Munger in connection with Harizan P.S. Case No. 3 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
