JUSTICE ARUN KUMAR ORAL ORDER 07-08-2018 Heard learned counsels for the petitioner and the State. The petitioners, already in custody, seek bail in connection with Brahampura P.S. Case No. 94 of 2018 registered under Sections 25(1-b)a, 26/35 of the Arms Act. Allegation in brief is that the two loaded country made pistols were recovered from rented hut of the petitioners. Submission is that there is no such recovery of arms and there is no compliance of Section-100 of Cr. P. C and the Seizure List bears the date of 30.03.2018 as date of recovery whereas the FIR is dated 09.04.2018.

Having considered the aforesaid facts and circumstances, the petitioners, namely, Vikash Ram @ Vikash Kumar and

Patna High Court Cr.Misc. No.48694 of 2018(2) dt.07-08-2018 2/2 Anwarul Haque are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Brahampura P.S. Case No. 94 of 2018.
