Petitioner is in custody in connection with Bajpatti P.S. Case No. 36 of 2019 for the offence under sections 272, 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case total 105 liters of Nepali Saufi Wine was seized.

Learned counsel submits that nothing was recovered from the possession of the petitioner or from the house of the petitioner. It was recovered from pitch road.
