Petitioner, already in custody, seeks bail in connection with Barari P.S. Case No.274 of 2017 registered under Sections 366, 376 and 506/34 of the Indian Penal Code. Allegation in brief is that the petitioner on the pretext of getting married with the prosecutrix took her to Delhi and established physical relationship but later on denied to marry with her.

Learned counsel for the petitioner submits that the girl is major, only in order to put pressure to the petitioner to marry with her, this false case has been lodged, even the medical report does not indicate any sign of rape and this case was

Learned counsel for the informant opposes the prayer of bail of the petitioner.

Having considered the aforesaid facts and circumstances, petitioner Md. Sultan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Katihar in connection with Barari P.S.
