JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-04-2019 The petitioners seek bail in anticipation of their arrest in connection with Mansurchak P.S. Case No. 80 of 2018, dated 10.10.2018, instituted for the offences under Sections 302 and 120(B)/34 of the Indian Penal Code. The son of the informant did not return for quite some time and, therefore, it was suspected that perhaps his wife, with whom he was not having good relations, has got

It further appears from the argument of learned counsel for the petitioner that the wife of the deceased was made an accused and on her arrest, she confessed that she took the help of the petitioners in eliminating the deceased. But for the aforesaid confession of the wife of the deceased, there is no other material to connect the petitioners with the aforesaid offence. The wife of the deceased is also said to be carrying affair with some another person, viz., Shiv Kumar Das. The petitioners have got no concern either with the wife of the deceased or with the deceased and his family.

Considering such far fetched allegation against the petitioners and that also on the basis of confession of the wife of the deceased, who happens to be a co-villager of the petitioners, they, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with
