JUSTICE SHIVAJI PANDEY ORAL ORDER 27-08-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceeding. In this case, the petitioner is seeking regular bail in connection with Sasaram (Town) P.S. Case No.840 of 2019, registered for the offence under Sections 304(B)/ 34 of the Indian Penal Code and under Section 3 / 4 of the Dowry Prohibition Act.

The case has been instituted under Section 306 of the Indian Penal Code. Allegation has been made that on account of demand of dowry and torture the daughter of the informant committed suicide. However, paragraph nos. 7 and 22 of the case diary suggests that the victim was suffering from "Hepatitis B" disease and the family members have separated the utensils of the victim, on that account, she went in depression and after that she committed suicide.

No.17667 of 2020(3) dt.27-08-2020 2/2 Considering the aforesaid facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Town) P.S. Case No.840 of 2019.
