This application for anticipatory bail arises out of Motihari Town P.S. Case No. 640 of 2018 for the offence under Sections 420, 467, 468 and 471/34 of the Indian Penal Code. On the allegation of interpolation in the records of rights, the First Information Report has been registered. Learned counsel appearing on behalf of the petitioner has submitted, referring to the First Information Report, that the petitioner is simply a Copying Clerk and his role has been described as suspicious in the letter dated 04.09.2018 of the In-charge Officer of the District Record Room, which is the basis for registration of the First Information Report.

I find substance in the submission so advanced on

Patna High Court CR. MISC. No.19210 of 2019(2) dt.29-03-2019 2/2 behalf of the petitioner. This application is accordingly allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari, in Motihari Town P.S. Case No. 640 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
