This application for regular bail arises out of Parasbigha P.S. Case No. 137 of 2019 (G.R. No. 1335/2019), disclosing offences punishable under Sections 304B and 201/34 of the Indian Penal Code. The petitioner is the husband of deceased, who is in custody since 17.10.2019. It is alleged in the First Information Report that the petitioner and his family members used to make demand for dowry. It is further alleged in the FIR that on 04.07.2019 the informant was informed by the petitioner that the deceased had committed suicide.

Learned counsel appearing on behalf of the

No.16169 of 2020(3) dt.08-06-2020 2/2 petitioner has submitted that incorrect date of marriage with the petitioner has been mentioned in the FIR to make out an offence under Section 304B of the Indian Penal Code. He has further submitted that upon completion of investigation, charge-sheet has been submitted and considering the nature of allegation, there is no chance of the petitioner tampering with the evidence. The petitioner is in custody since 17.10.2019. Considering the facts and circumstances as noted above, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in Parasbigha P.S. Case No. 137 of 2019 (G.R. No. 1335 of 2019).
