The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,354B,307 and 379/34 of the Indian Penal Code. The prosecution case is that the daughter-in-law of one Gulab Rai left her matrimonial house for three days and when she returned, the accused persons after forming unlawful assembly went to the house of the informant and dragged her to the village temple and assaulted with fists and slaps. It is also alleged that co accused Lagan Rai stripped her whereas co accused Ram Lagan Rai put towel round her neck and started pulling with intention to kill her and co accused Gulchan Rai along with others cut her hair

Patna High Court Cr.Misc. No.31365 of 2015 (2) dt.04-08-2015 2/2 though it is also alleged that Gulchan Rai tried to strangulate her. It is submitted by the learned counsel for the petitioner that the accusation is not specific against the petitioner and statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Benipatti P.S. Case No. 140 of 2014 pending in the court of learned CJM, Madhubani. This application is disposed of with the aforesaid observation/direction.
