The petitioner, already in custody, seeks bail in connection with Mahila P.S.Case No. 37 of 2015 registered under Sections 323, 354B, 376, 504 and 511/34 of the Indian penal Code.

Allegation in brief is that petitioner along with his nephew used to harass the informant and one night, entered into her house also and made an attempt of rape.

Submission is that petitioner is Headmaster in the middle school and the allegation is absurd. Both sides are neighbours and due to some dispute with respect to throwing of garbage on the land of the petitioner false accusation is made and in this regard Annexure-3 is relevant document that is inquiry report in the matter and co-accused Md. Shamshad Alam has been

Patna High Court Cr.Misc. No.41981 of 2018(3) dt.26-07-2018 2/2 granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 63366 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Md. Shamsher Alam @ Shamsher Alam is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Gaya in connection with Mahila P.S. Case No. 37 of 2015.
