The petitioners seek bail in Amba P.S. Case No.85 of 2017 registered under Sections 379 and 411 of the Indian Penal Code.

As per the prosecution case, the truck of the informant is said to have been stolen by some unknown miscreants from the Petrol Pump.

It is submitted by learned counsel for the petitioners that the petitioners are neither named in the F.I.R. nor the stolen truck was recovered from their possession rather the stolen truck was recovered near the village Chakkanbagh on NH 139. As a matter of fact, the informant has taken the aforesaid truck on premium and as he could not pay the premium he had taken

Patna High Court Cr.Misc. No.53919 of 2017 (02) dt.10-11-2017 2/ 2 money from the transporter Laddu Tiwari alias Laddu Pandey and paid the premium under agreement to take the truck back after paying the amount. Petitioners happen to be driver and khalasi of said transporter and they were taking meal at the line hotel located near the place of recovery of the said truck. The petitioners have been languishing in custody since 02.08.2017. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Amba P.S. Case No.85/17.
