JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2017 The petitioner seeks regular bail in connection with Madhepura/Bharehi P.S. Case No. 581 of 2016, registered for offences punishable under Sections 341, 323, 324, 307, 379, 504, 506/34 of Indian Penal Code.

Allegation against the petitioner is of assault to the informant on his head by means of dabiya.

It has been submitted on behalf of the petitioner that there is a counter version also, in which petitioner has also received grievous injury and there was no intention of the petitioner to kill the informant, which will appear fro the fact that there is no repetition of blow. Further petitioner has been in custody for last three months.

Heard learned A.P.P. also.

No.55243 of 2017 (2) dt.22-11-2017 Having heard both sides, considering the fact and circumstances of the case and nature of allegation, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to expedite the commitment and after commitment try to conclude the trial within a period of six months and if the trial is not concluded within the aforesaid period and there is no fault on the part of the petitioner in delaying the trial, the trial court shall release the petitioner on bail to his own satisfaction.
