JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2018 Earlier prayer for bail of the petitioner has been rejected by this Court in Cr. Misc.No. 21867 of 2017, vide order dated 10.5.2017 with a direction to the trial court to expedite the trial. Submission of learned counsel for the petitioner is that though he is accused in four other cases but he is on bail on those cases and further submission is that there is no recovery from his possession rather recovery is from the possession of one Pradeep Kumar, son of Ganauri Yadav, who has been granted bail by a coordinate Bench of this Court in Cr.Misc.No. 14325 of 2014, vide order dated 18.6.2014 and he is in custody for more than one year and there is no progress in trial.

In the facts and circumstances and from perusal of the
Patna High Court Cr.Misc. No.61641 of 2017 (3) dt.24-01-2018 2/2 report it appears that the case is fixed for framing of charge and petitioner is in custody for more than one year, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Sherghati, Gaya, in connection with Dumariya P.S.Case No. 6 of 2012, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable property within the jurisdiction of court concerned and (2) petitioner will mark his attendance in local police station in first week of every month till conclusion of trial, otherwise his bail bond shall be cancelled by learned court below on its own or on the prayer of prosecution. Let this order be communicated to the Superintendent of Police, Gaya for compliance of the order.
