Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

It is alleged that 81.72 liters of illicit liquor was recovered from a tempo.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is neither driver nor owner of the vehicle. No incriminating material has been recovered from the conscious possession of the petitioner.

Learned counsel for the State submits that petitioner

Patna High Court CR. MISC. No.20176 of 2023(2) dt.15-05-2023 2/2 has got three criminal antecedent of similar nature. Considering the facts of the case that petitioner has got three criminal antecedent of similar nature, prayer for anticipatory bail is rejected.
