JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 The petitioner is apprehending his arrest in connection with Dhanarua P.S. Case No. 257 of 2014 for the offences instituted under Sections 147, 148, 149, 307 of the IPC and 27of the Arms Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that when the informant was in his house and was talking over the phone, the petitioner alongwith other accused persons came armed with pistol got into altercation fire was opened.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is aged 72 years. Though the allegation is of

Patna High Court Cr.Misc. No.29763 of 2015 (2) dt.28-07-2015 2/2 causing injury but the same is on non vital part of the body. There is land dispute also between the parties.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Dhanarua P.S. Case No. 257 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Masaurhi, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
