The petitioner seeks bail in anticipation of his arrest in connection with Sursand P.S. Case No. 176 of 2018 dated 05.07.2018 instituted for the offences under Sections 363, 366(A), 379 and 34 of the Indian Penal Code.
Though the petitioner is alleged to have abducted/kidnapped the 16 year old daughter of the informant but the victim, on her return, has given her 164 Cr.P.C. statement in which she has refuted the aforesaid allegation. In the aforesaid statement, the victim has disclosed her age to be 18 years. The learned Magistrate recording her statement has also assessed her age to be 19 years.
The victim girl has stated that she had

Considering the aforesaid statement of the victim girl, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Sursand P.S. Case No. 176 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
