2. The sole grievance which the petitioner has is that the Governing Body of Luxminath College, Bangaon, Saharsa, an affiliated College under B.N.Mandal University, Madhepura, has not been duly constituted in accordance with the provisions of the Statute.
3. From the materials on record, it appears that a Governing Body was constituted on 07.10.2013. However, from the notification in relation to constitution of the Governing Body, it appears that no members against the quota, viz, Teacher
Patna High Court CWJC No.15606 of 2016 (5) dt.24-08-2017 2/2 Representative, Donor Representative and Educationist have been nominated so far.
4. The Statute provides the procedure for election of the Donor Representative and Teacher Representative. The matter appears to be pending with the Chancellor of the Universities of the State of Bihar as appears from the communication dated 01.03.2017, made by the Registrar of the University to the Principal of the said College.
5. In such circumstance, this application is disposed of with an observation that the B.N. Mandal University, Madhepura shall take all steps to ensure that the Governing Body is constituted in accordance with the provisions of the Statute within a period of six months from the date of receipt/production of a copy of this order before the Vice-Chancellor of the said University.
