The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 142 bottles of officers choice blue (each containing 180 ML.), 39 bottles of officers choice blue (each containing 375 Ml.), 8 bottles of Srilab Blue Rock (each containing 180 ML.), 158 bottles of Srilab Blue rock (each containg 375 ML.), 96 bottles of imperial blue (each containing 180 ML.), 12 bottles of Imperial Blue (each containing 750 ML.), 80 bottles of Mcdowells No.1(each containing 180 ML.), 38 bottles of Mcdowells Green Label (each containing 180 ML.) and 21 bottles of Contessa XXX
Patna High Court Cr.Misc. No.52834 of 2017(2) dt.09-11-2017 2/2 Rum (each containing 375 ML.) liquor were recovered from the house of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 11.08.2017. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Nasariganj P. S . Case No. 168 of 2017.
Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
