The petitioners apprehend their arrest in Sirdala P.S. case No. 13 of 2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The informant, S.H.O. of Sirdala P.S., alleged that he got information about the fact that Pintu Choudhary was indulged in preparation of country made liquor in his field and on such field of Pintu Choudhary was searched and different articles meant for preparation of country made liquor were recovered. The field of petitioners was also searched and different articles meant for preparing country made liquor including Mahua and Gur were recovered.

Patna High Court CR. MISC. No.16937 of 2019(2) dt.26-03-2019 2/2 The learned counsel for the petitioners submits that no seizure list was prepared. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have got no criminal antecedent.

Taking into consideration the fact that some articles are said to have been recovered from the field of petitioners but no seizure list was prepared and the petitioners have got no criminal antecedent, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Court, Nawada in connection with Sirdala P.S. case No. 13 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
