JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-05-2017 The present application has been filed seeking recall of the order, dated 01.04.2014, passed in CWJC No. 22539 of 2012. Learned Counsel for the petitioner has submitted that the Court missed to take into account the fact that no formal order of cancellation of appointment was ever issued.
I do not find any substance in the submissions so advanced on behalf of the petitioner. The said order, dated 01.07.2014, is based on admitted fact that the petitioner had qualification of Madhyama Vishrad acquired from Hindi Sahitya
Sammelen, Allahabad, which is not a recognized qualification for appointment as teacher.
Since the petitioner did not have the basic qualification for appointment or absorption as Panchayat Teacher, I do not find any reason to accede to the prayer made on behalf of the petitioner in the present application.
This application has no merit and it is, accordingly, dismissed.
