Petitioners apprehend their arrest in connection with Laxmipur P.S.Case No. 161 of 2017 registered for the offences punishable under Sections 376D, 365/34 of the Indian Penal Code and Section 6 of Lady Trafficking Act.
Allegation against the petitioners is that they have committed rape upon the informant.
Submission of learned counsel for the petitioners is that police after investigation has not found the case true under Section 376D IPC, rather there is allegation under Section 498A IPC and petitioners are relatives of husband of the informant. Heard learned APP also.
Patna High Court Cr.Misc. No.49410 of 2018 (2) dt.29-08-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioners, rather petitioners to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and to be disposed of, if possible, on the same day.
