13-09-2017 Heard Sri Dhananjay Kumar Pandey, learned counsel for the petitioner and Sri Shekhar Singh, learned counsel appearing on behalf of opposite party/Eastern Railway, Kolkata. The present petition has been filed with a prayer to restore M.A. No. 404 of 2013, which stood dismissed due to noncompliance of peremptory order dated 01-12-2014. After hearing learned counsel for the parties and considering the fact disclosed in the petition, same is allowed. Let M.A. No. 404 of 2013 be restored to its original file. It is clarified that if order dated 01-12-2014 passed in M.A. No. 404 of 2013 is not complied with by 16th October, 2017, the Misc. Appeal i.e. M.A. No. 404 of 2013 shall stand dismissed without further reference to a Bench.
