This application is for grant of regular bail in connection with Naugachia P.S.Case No.163 of 2017 (G.R.No.329 of 2017) for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25 (1-b), 26 and 36 of the Arms Act.
Petitioner is not named in the FIR and one looted pistol has been recovered from him.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case. He is having no criminal antecedent and he is in custody for about six months. Heard learned A.P.P. also.
Having heard both sides and in view of facts as stated
Patna High Court Cr.Misc. No.61842 of 2017 (3) dt.11-01-2018 2/2 above, I am not inclined to grant bail to the petitioner, however, in view of the fact that he was involved in dacoity and one pistol has also been recovered from him as well as he is in custody for about six months, the learned trial court is directed to expedite the trial of the petitioner.
With the aforesaid observation, this application is dismissed.
