JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Rajgir Police Station Case No.331 of 2019 registered under Section 394 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the fardbeyan of the informant, the present case was instituted under Section 394 of the Indian Penal Code on 04.09.2019 against four unknown thieves. In course of investigation, one Pintu Sahani was apprehended by the police from whose possession cash Rs.4000/- and robbed mobile sets are said to be recovered. Patna High Court CR. MISC. No.16064 of 2020(2) dt.05-06-2020 2/2 confessional statement. Except the confessional statement of the co-accused Pintu Sahani, nothing has been collected by the Investigating Officer against the petitioner in course of investigation to show his involvement in the present case. The petitioner has no criminal antecedent and is in custody since 11.12.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Biharsharif (Nalanda), in connection with Rajgir Police Station Case No.331 of 2019.
