JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Madhepura PS case no. 596 of 2017 instituted for the offences punishable under various Sections of Indian Penal Code and 37(b)(c) & 45 of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding the petitioner being found in drunken condition and he having allegedly abused and assaulted the police personnel by hands and fists. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that petitioner is accused in three other cases in which, he is on bail. It is further submitted that petitioner is in

Considering the nature of accusation, I deem it fit and appropriate to impose harsh condition on the petitioner for grant of bail. In the facts and circumstances of the case, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 1 lac (Rs. One lac) with two sureties of the like amount each to the satisfaction of A.D.J.-IIIrd-cum-Special Judge, Excise Act, Madhepura in Madhepura PS case no. 596 of 2017. It is further directed that the petitioner will mark his attendance before the SHO of the concerned police station at 10 am on every Monday of each week and upon two consecutive defaults in doing so, the present privilege of bail shall stand cancelled automatically and the petitioner shall be taken into custody forthwith.
