2. The learned counsel for the petitioner has submitted that on account of inadvertence, the list could not be marked, hence the case remained unattended when the same was called out for hearing, however, the same act would not be repeated again.

3. Having regard to the submission made by the learned counsel for the petitioner as also considering the

Patna High Court MJC No.846 of 2024(2) dt.06-09-2024 2/2 averments made in the present petition, I deem it fit and proper to restore the aforesaid writ petition bearing CWJC No.3339 of 2023 to its original file.
