====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 27-07-2018 Heard learned counsel for the petitioner and the State.
This is an application for regular bail in connection with Bhairabstahan P.S. Case No.26 of 2018 giving rise to G.R. No.312 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code.
Informant in his written complaint has stated that he is a courier delivery boy and used to deliver the articles to different customers and on 16.03.2018 while he was on his way to deliver articles to different customers at a lonely place three persons on motorcycle snatched several articles from his possession and fled away. During investigation one accused
Patna High Court Cr.Misc. No.45723 of 2018(2) dt.27-07-2018 2/2 Sonu Thakur was arrested and from his possession several looted articles were recovered. The name of petitioner has surfaced in this case on the basis of confessional statement made by Sonu Thakur but nothing has been recovered from his possession and he has no criminal antecedent. It has been submitted on behalf of the petitioner that main accused Sonu Thakur has already been granted bail by this Court in Criminal Miscellaneous No.40039 of 2018.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur, Madhubani in connection with Bhairabstahan P.S. Case No.26 of 2018 giving rise to G.R. No.312 of 2018. (S. Kumar, J) sudip/manoj U T
