Mr. Narendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-04-2025 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing on behalf of the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 329(3), 126(2), 115(2), 118(1), 109, 303(2), 125(a), 352, 351(2) and 3(5) of the B.N.S..

3. As per prosecution case, all the F.I.R. named accused persons, including these petitioners, assaulted informant and his father as a result of which, informant sustained severe injuries on his ear and head and his little finger got fractured.

4. It is submitted by learned counsel appearing on

Patna High Court CR. MISC. No.20162 of 2025(2) dt.21-04-2025 2/3 behalf of the petitioners that petitioners are quite innocent and have committed no offence. There are general and omnibus allegation of assault against Petitioner No. 2 and there is no specific accusation of overt act against him. Petitioner No. 2 claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that petitioners are named in the F.I.R. with specific accusation that they assaulted informant and his father. Petitioner No. 1 is alleged to have hit on hand of informant by means of brick as a result of which one finger of informant got fractured and doctor has found the injury grievous in nature. Petitioner No. 1 has got one criminal antecedent.

6. Considering the specific and direct nature of accusation, nature of injuries sustained by the injured and criminal antecedent, the prayer for grant of anticipatory bail to Petitioner No. 1 is rejected.

7. So far as Petitioner No. 2 is concerned, considering the general and omnibus nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to Petitioner No. 2 is allowed.

8. Accordingly, in the event of arrest/surrender within
