Since, the present writ application was registered on 08.07.2015, but till date no counter affidavit has been filed. Hence, this Court is not inclined to adjourn the matter any further.
Patna High Court CWJC No.9867 of 2015(2) dt.22-09-2017 2/3 The nature of order this Court intends to pass, does not require issuance of notice to private respondent nos. 5 to 8. The present writ application has been filed for a direction to the respondent authorities to get the measurement and demarcation of the land of the petitioner, appertaining to Khata No. 42, Plot No. 1915, Thana No. 7, situated in Mauza Saristabad, Noniya Toli, District Patna, done. It is submitted by learned counsel for the petitioner that the land in question was purchased by registered sale deed on 19.07.1957, but private respondent nos. 5 to 8 are disputing the boundary wall of the land of the petitioner.
Learned counsel for the petitioner prays for disposal of the present writ application with a direction to respondent no.4, the Circle Officer, Sadar, Patna to dispose of the representation of the petitioner dated 28.11.2014, as contained in Annexure-3 (series), submitted before him for getting the land in question measured and demarcated.
In the circumstances, it is expected from respondent no. 4, the Circle Officer, Sadar, Patna to dispose of the representation of the petitioner, as contained in Annexure-3(series), if it has already not been disposed of, within a period of three months from the date of receipt/production of the copy of this order.
