2. In the present case, the petitioner is apprehending his arrest in connection with Nayagaon P.S. Case No.83 of 2024, registered under Sections 191(2), 191(3), 190, 126(2), 115(2), 352, 351(2), 109, 117(2) of BNS.

3. As per the prosecution case, the petitioner and other co-accused persons assaulted the informant and one Krishna Yadav with farsa, iron rod and lathi danda causing injuries to them. Thereafter, they tied the informant and threw him in the water treating him to be dead. The occurrence took place in the background of earlier case of assault filed by the informant's side.

4. The learned counsel for the petitioner submits that

There is an old land dispute between the parties and in order to pressurize the petitioner's side, this false case has been lodged. The learned counsel further submits that several coaccused persons have been granted anticipatory bail by a Coordinate Bench of this Court vide orders dated 08.10.2025 passed in Cr. Misc. Nos.38784/2025 & 39570/2025, respectively. The case of the petitioner is similarly placed and only general and omnibus allegations have been levelled against the petitioner as well other co-accused persons, who have been granted anticipatory bail by the learned Coordinate Bench. The learned counsel further submits that no injury report has been brought on record and it shows the injuries are non-existent. The petitioner is having antecedent of one case and he is on bail and the said case has been filed by the informant's side.

5. The learned APP vehemently opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the non-specific nature of allegation and background of earlier dispute of the parties and further considering the possibility of false accusation, let the petitioner above named in the event of

No.28983 of 2026(2) dt.06-05-2026 3/3 his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/court concerned, in connection with Nayagaon P.S. Case No. 83 of 2024, subject to the condition laid down under Section 482 (2) of the BNSS, 2023 and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the below, if so required by the learned trial court.
