Mr. Umesh Lal Verma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 03-07-2025 Heard Mr. Hafiz Shahbaz, learned counsel for the petitioner and Mr. Umesh Lal Verma, learned APP for the State.

2. The petitioner is apprehending his arrest in connection with Jamui P.S. Case No. 420 of 2024, F.I.R. dated 05.07.2024 for the offences punishable under Section 96 of the BNSS.

3. According to prosecution case, the informant alleges that his minor daughter was called upon by one Rozy Khatoon in her house and after that the petitioner took away her duaghter.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case due to some village politics. He further submits that the allegation as alleged in the F.I.R. is false

Patna High Court CR. MISC. No.20019 of 2025(3) dt.03-07-2025 2/2 and fabricated and the petitioner has not committed any offences as alleged in the F.I.R.

5. The learned Additional Public Prosecutor on the basis of material available on record and case diary has vehemently opposed the prayer for bail of the petitioner and submits that the victim was recovered and her statement was recorded under Section 164 of the Cr.P.C. in which she has categorically stated that petitioner has committed wrong with her and apart from that medical report of the victim also suggests that she has been sexually assaulted by the petitioner.

6. Considering the allegation as alleged in the F.I.R and the material available on record, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Jamui P.S. Case NO. 420 of 2024 pending in the court of learned Addl. Sessions Judge-I, Jamui.

7. Prayer is refused.
