====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Darbhanga (Jainagar) Rail P.S. Case No. 319 of 2018, instituted for the offence under Section(s)370, 376 of the Indian Penal Code, Sections 4, 6, 8 of POCSO Act, Sections 9, 10 and 11 of Child Marriage Prohibition Act, 2006.

It is alleged in the written report that victim girl (informant) was forced to marry with Ram Awtar by her father against her wishes. Allegation against the petitioner is that he also managed the father of victim girl (informant) to agree to perform marriage with Ram Awtar. It is further alleged that Ram Awtar committed illegal act with the informant in the

As such, in the written report there is no allegation of any specific overt act against the petitioner. Petitioner is in custody since 22.12.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st-cum-Special Judge, Madhubani, in connection with Darbhanga (Jainagar) Rail P.S. Case No. 319 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
