====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Pothia P. S. Case No. 72 of 2024 in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

3. As per prosecution case, all the F.I.R. named accused persons including these petitioners along with 10-15 unknown persons looted cattle of the informant.

4. Learned counsel for the petitioners submits that no looted cattle was recovered either from possession of these petitioners or from their houses. Petitioners have been made

Patna High Court CR. MISC. No.21949 of 2025(2) dt.16-05-2025 2/2 accused only on suspicion. Petitioner Nos. 1 and 2 are not named in the F.I.R. Petitioners are in custody since 05.02.2025. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Pothia P.
