JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of Economics Offence Unit, Government of Bihar, Patna.

The petitioner apprehends his arrest in connection with Economic Office P.S. Case no. 07 of 2013 (Special Case No. 05 of 2013), registered under Sections 109 and 120-B of the Indian Penal Code and Section 13(1) of the Prevention of Corruption Act, 1988. The accusation is that Nageshwar Sharma, son of Badri Sharma (Petitioner), being the Executive Engineer of PHED, Samastipur acquired disproportionate assets worth of Rs. 4,20,61,036/- in the name of himself, his father, wife, and children. Learned counsel for the petitioner submits that petitioner is the father of Nageshwar Sharma, Executive Engineer, PHED,

Patna High Court Cr.Misc. No.23200 of 2016 (8) dt.09-08-2017 2/2 Samastipur and he is a retired Headmaster of school and after retirement he sold some lands and purchased vehicles and started business of transport, but he has also been implicated in this case being the father of Nageshwar Sharma. Further submission is that after investigation, the Police has already submitted chargesheet and the vehicles of the petitioner has also been released in his favour on executing the surety bonds. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge-1st, Vigilane, Patna in connection with Economic Offence P.S. Case No. 07 of 2013 (Special Case No. 05 of 2013), subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
