JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Bidupur Police Station Case No.433 of 2019 registered under Sections 413 and 414/34 of the Indian Penal Code.

The accusation is that in course of checking of the vehicles by the informant along with other police personnel, two persons were seen coming on Black Colour Pulser Motorcycle having no registration number. On seeing the police party, they started to flee away but, on chase, they were apprehended, who disclosed their name as Aditya Thakur (petitioner) and Raju Kumar. On query, they could not produce the paper regarding the ownership of the motorcycle nor give satisfactory reply.

Patna High Court CR. MISC. No.16083 of 2020(2) dt.05-06-2020 2/2 They disclosed that the said motorcycle is stolen one and it was also detected that the petitioner is accused in Mahua P.S. Case No.254 of 2019 registered on 13.09.2019.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner had taken the lift on the motorcycle of the co-accused Raju Kumar but he has falsely been implicated in this case. In the present case, the petitioner is in custody since 03.11.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur Police Station Case No.433 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner.
