The petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code, Section 27 of the Arms and under Section 3 (2) (v) of the SC and ST Act. The petitioner is of course named in the FIR but no specific allegation of either abusing or assault is made against the petitioner. The petitioner is only alleged to have given Lathi to other accused persons. The allegation of firing is against Anandi Mahto.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of
Patna High Court Cr.Misc. No.30034 of 2015 (2) dt.28-07-2015 2/2 receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Kashichak P.S. Case No. 01 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
